Terms of Service

1) Access and accounts

You must provide accurate registration data and keep your credentials secure. You are responsible for all activity under your account. “Lifetime access” means access for as long as we continue to offer the course platform and hosting in commercially reasonable form.

• One account is intended for one individual unless a team license is explicitly purchased.
• We may suspend accounts involved in fraud, abuse, or policy violations.
• You must be at least 16 years old (or the age of majority in your jurisdiction) to create an account.

2) Payments, taxes, and refunds

All prices are in USD unless stated otherwise. Taxes may apply based on your location. Payment processing is handled by our payment providers; you agree to their terms where applicable.

Certain items may be non-refundable if clearly marked (e.g., one-time consultations already delivered).

3) Acceptable use

You may not resell, share, sublicense, or distribute course materials without written permission. Respect intellectual property rights and community standards.

• No scraping, probing, or reverse engineering of the platform.
• No uploading malicious code or content that violates laws or third-party rights.
• No harassment, hate speech, or deceptive behavior in community features.

4) Content ownership and license

FairGate Gardening and its licensors own the platform and course materials. Upon purchase, you receive a personal, non-transferable, non-exclusive license to access the content for your own learning purposes.

You may download materials only where a download option is provided, and only for personal use. Removing copyright notices is prohibited.

5) Service changes and availability

We may update features, course content, or pricing. We aim to keep the platform available, but outages may occur for maintenance or factors beyond our control.

If a course is retired, we may provide a reasonable alternative, a replacement course, or access for a transition period.

6) Disclaimers

Educational content is provided “as is” and “as available.” We do not guarantee outcomes. Gardening results vary due to climate, soil, and other factors.

To the extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.

7) Limitation of liability

To the maximum extent permitted by law, FairGate Gardening will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data.

Our total liability for any claim relating to the services will not exceed the amount you paid for the applicable course in the 12 months before the event giving rise to liability.

8) Termination

You may stop using the services at any time. We may suspend or terminate access if we reasonably believe you have violated these terms.

Upon termination, your right to access the services will end immediately, except where we are required by law to provide continued access.

9) Governing law

These terms are governed by applicable laws based on our operational jurisdiction, without regard to conflict of laws rules. Where required, mandatory consumer protections in your region may still apply.
